Every purchase at “Artista in Luce” by Renato Bruno is regulated by Civil Code and Consumer Code and is subject to the acceptance of these Terms of Sale regulating the contractual relationship of sale between “Artista in Luce” by Renato Bruno and the buyer (Customer), at the time of purchase.
The Customer who wishes to purchase the creations (lamps) through the website of “Artista in Luce” by Renato Bruno is required to read these conditions carefully, and is hereby informed that these terms of sale can be viewed, downloaded or printed at any time.
1.1 These Terms become effective as of their publication on the Artist’s website and until they have been expressly revoked by Renato Bruno’s “Artista in Luce” or replaced by new conditions.
1.2 “Artista in Luce” by Renato Bruno reserves the right to modify and/or update these Terms at any time without notice; any change become effective as of its publication on the website.
1.3 The Terms of Sale, together with the Customer’s Order Confirmation, constitute the Contract between “Artista in Luce” by Renato Bruno and the Customer.
2.1 Each lamp is a one-off, unique creation and is described in detail on the website. Since Artistic lamps are entirely handmade, any discrepancies and / or imperfections must be considered typical characteristics of the uniqueness of the lamp and can never be contested. Without prejudice to the essential characteristics of the described models, “Artista in Luce” by Renato Bruno reserves the right, with a view to improve its creations, to make at any time: formal and dimensional changes;
changes in details or finishes; changes of parts; technical variations. It also reserves the right to remove any lamps at any time and without notice
2.2 All lamps are registered with the EUIPO.
“Artista in Luce” by Renato Bruno will supply the lamps according to the availability shown on the website and will accept orders exceeding the availability shown on the website only after having agreed with the Customer upon the delivery times; these agreements will definitively become effective once the Order Confirmation is sent to the Customer.
4.1 The prices of the lamps indicated on the website are expressed in Euros and do not include any expenses for services that may be requested by the Customer.
4.2 The shipping costs are at Customer’s expenses, with the exception of promotions and of any prospective agreement on the basis of which “Artista in Luce” by Renato Bruno will decide that the shipping cost are at its own expenses. The shipping cost, calculated automatically by the system, will
be indicated in the Purchase Order before it is sent by the Customer.
4.3 The final cost of the purchase includes the price of the lamps, costs for shipping, taxes, fees, etc.
4.4 The final cost of the purchase does not include the costs for customs and optional services, which are always charged to the Customer.
4.5 “Artista in Luce” by Renato Bruno reserves the right to change at any time, at its sole discretion and without notice, the price of the lamps on the website. Were any incorrect price to appear on the website, “Artista in Luce” by Renato Bruno reserves the right to modify it before the Order Confirmation. The price variation will be promptly communicated to the Customer, who can accept the change or cancel the order.
On the contrary, any price that has been agreed on and accepted in the Order Confirmation will not be amenable to changes.
5.1 Placing orders is only allowed to Customers who have reached the age of 18 (eighteen).
5.2 Orders are placed by using the online wizard available in the appropriate section of the site. Order proposals in other written forms may be considered only after having been accepted by by “Artista in Luce” by Renato Bruno.
5.3 Once the order has been placed, “Artista in Luce” by Renato Bruno will send an email notifying the Customer of the receipt of order and providing the Customer with the order’s identification number and purchase summary. Customer can verify the data accuracy, the purchased items and, if necessary, report anomalies and /or errors by sending an email to the following e-mail address: info@renatobrunoartistainluce.com
6.1 The payment of lamps purchased at “Artista in Luce” by Renato Bruno is always in advance and can be made by bank transfer or PayPal. Payment can only be made in EURO.

6.3 For payments made by credit card, “Artista in Luce” by Renato Bruno makes use of PayPal platform, which allows for absolutely safe payments by encrypting all confidential and sensitive data;
“Artista in Luce” by Renato Bruno will not retain any personal and financial information about the customer or the Credit Card used for making the payment.
6.4 Under no circumstances “Artista in Luce” by Renato Bruno will take any responsibility for fraudulent or illegal use of credit cards made by third parties during the purchasing process.
7.1 The purchase order acceptance and the sending of the Order Confirmation are made upon verification of the payment made by the Customer. More precisely, before sending the Order Confirmation, “Arista in Luce” by Renato Bruno will verify either the payment authorization by the
banking circuit, in case of payment by PayPal, or the receipt of the bank transfer in favor of “Artista in Luce” by Renato Bruno, in case of payment by bank transfer.
7.2 In case of refusal and/or further problems, “Artista in Luce” by Renato Bruno may directly contact the Customer, if possible, in order to find a solution.
8.1 Orders will be processed within an approximate and non-binding period of 30 (thirty) days as of the date of Confirmation of the Order.
8.2 The Customer may, at his/her own expenses, apply to a trusted courier. If no clear instructions about the courier are given by the Customer, “Artista in Luce” by Renato Bruno will carry out the shipment using a carrier of its own trust. In case of problems related to the shipment of the items, under no circumstances will grievances or complaints be heard. Under no circumstances will Renato Bruno’s “Artista in Luce” be held responsible for tampering, theft or failure during transport.
8.3 Upon delivery of the lamps to our carrier, an e-mail will be sent to the Customer with the Shipping Confirmation.
8.4 The delivery of the lamps to the Customer in Italy is processed within an approximate and non-binding period of 5 (five) working days, starting from the date of Confirmation of Shipment by “Artista in Luce” by Renato Bruno.
8.5 The delivery of the lamps to the Customer in the EU and non-EU territory is processed within an approximate and non-binding period of 7 (seven) working days as of the date of Confirmation of Shipment by “Artista in Luce” by Renato Bruno.
8.6 The customer must make the payment even if the scheduled date for delivery is refused, and any cost related to the delivery will be charged to the customer, as though the delivery had really occurred.
Any cost resulting from this refusal (e.g. warehouse costs) will be charged exclusively to the Customer, unless otherwise agreed by the parties.
8.7 In the event that the lamps are not delivered after 15 (fifteen) working days from the date of Confirmation of Shipment by “Artista in Luce” by Renato Bruno, the Customer can send an e-mail to info@renatobrunoartistainluce.com providing the order number and any notes, with the subject: “non-delivery”. After receiving this e-mail and after carrying out the appropriate checks, “Artista in Luce” by Renato Bruno will contact the Customer, approximately within 3 (three) working days, answering the Customer’s request for information.
8.8 The Customer is required to check, upon receipt of the lamps ordered: whether the number of packages in delivery corresponds to the number indicated on the transport document; whether the packaging is intact; whether the lamp delivered complies with the Purchase Order.
9.1 The invoice for the purchase of the lamps at “Artista in Luce” by Renato Bruno will be issued on the date of payment confirmation and will report the data provided by the Customer at the time of theorder. The invoice will be sent to the Customer by e-mail and will act as a valid record for the legal
warranty.
9.2 Orders placed by professionals domiciled in one of the Member States of the European Union will be processed only if their Community VAT number is registered in VIES.
9.3 No change in invoice will be possible after the invoice has been issued.
10.1 If the lamps do not meet with the Customer’s requirements, after the dischargement of the contract the Customer can exercise the right to cancel, without any penalty and without specifying the reason why, by sending a recorded delivery letter with advice of deliver within 14 (fourteen) as of the receipt of the lamp. The letter must be sent to the address shown on the purchase invoice. The proof of delivery provided by the courier will act as valid evidence of the date of receipt of the lamp.
The postmark will act as valid evidence of the date dispatch of the recorded delivery letter with advice of deliver.
10.2 The Customer is bound to return the goods within 14 (fourteen) days as of the date on which the right to cancellation is exercised and notified. The shipping cost of the returned lamp will be at the Customer’s expense.
10.3 Once the lamp is returned to “Artista in Luce” by Renato Bruno, it will confirm the intactness of returned lamp. If the lamp is intact, “Artista in Luce” by Renato Bruno will issue a refund by bank transfer within 30 (thirty) days as of the return of the lamp. The refunded money will amount to the actual cost of the lamp, NOT including the shipping costs, taxes and the cost of the services requested by the Customer on payment.
10.4 The Customer forfeits the right to cancelation if: the lamp has not been properly packed in the original packaging; the lamp has been damaged for reasons not due to transport; the lamp has been used and/or worn out; parts of the lamp have been removed.
The lamp sold by “Artista in Luce” by Renato Bruno is covered by the Legal Warranty of Conformity provided for by articles 128-132 of the Consumer Code.
11.1 DURATION
In virtue of the Legal Warranty, “Artista in Luce” by Renato Bruno is responsible for lack of conformity making the lamp unsuitable for the intended use. Only the malfunctions occurring within two years from the delivery of the lamp will be deemed results of lack of conformity.
The Professional Customer, as defined in art. 3 of Consumer Code, has the right to make use of the Legal Warranty provided for by Civil Code within the maximum period of 12 (twelve) months from the delivery of the lamp.
11.2 CONDITIONS
This warranty will become effective only on condition that:

11.4 In the event that the Customer alters and/or modifies or destroys the lamp, and in the event that a lamp not conforming to the purchased one is returned, “Artista in Luce” by Renato Bruno will be
relieved of any responsibility and the Customer will not benefit from the remedies referred to in point 11.3.
11.5 The Customer may not request any compensation or other remedies beyond those listed above to “Artista in Luce” by Renato Bruno, nor will the Customer benefit from any remedy after the end of the warranty period.
12.1 “Artista in Luce” by Renato Bruno will not be responsible for malfunctions and defects due to:
12.2 By issuing the order, it is understood that the Customer has previously verified that the lamp is suitable for the intended use in the country of destination, excluding any responsibility of “Artista in Luce” of Renato Bruno for the consequences deriving from any constructional or certification differences.
12.3 In case of damage caused by the lamp to third parties due to non-compliance with the requirements or regulations relating to assembly, installation, use and maintenance, including the modification of the lamp itself, the Customer expressly undertakes to indemnify Renato Bruno’s
“Artista in Luce” from any question, action, claim, cost and expense, including legal expenses, of third parties.
12.4 In any case, it is understood between the parties that the responsibility of “Artista in Luce” of Renato Bruno in case of damage resulting from the lamp, as well as any costs or expenses related to it, may not amount to more than twice the original cost of the lamp purchased by the Customer.
13.1 “Artista in Luce” by Renato Bruno undertakes to safely guard Customer’s sensible data such as name, address or credit card number and all other data used for online purchases. All information provided during the purchase process will be guarded with the utmost attention in order to ensure the security of purchases and Customer’s data.
13.2 By forwarding the order, the Customer agrees that “Artista in Luce” by Renato Bruno can store,process and use the data contained in the order to process the order itself. Some of the information provided by the Customer will be transferred to the companies to whom the shipment of the lamps is
entrusted.
13.3 The Customer who purchase a lamp from Renato Bruno’s “Artista in Luce” is aware that all Customer’s personal data will only be used in the context of the Customer’s purchase from “Artista in Luce” by Renato Bruno and only in compliance with the law, and is aware that verification,
integration and/or deletion from our archives can be requested at any time.
“Artista in Luce” by Renato Bruno is exempt from any liability in case of delays or failures caused by force majeure. In the event of a delay, the contractual obligations agreed upon will be executed as soon as reasonably possible. In any event, compensation for any damage is excluded.
The execution, interpretation and all matters relevant to the validity and effects of these Terms of Sale and Legal Warranty will be determined and regulated by Italian law.
Any dispute arising from these Terms of Sale and Legal Warranty or related to them will be referred to the exclusive jurisdiction of the Court of Enna, with the explicit exclusion of any other alternative
forum.
16.1 Any change to the Terms of Sale must be agreed to by the Parties in writing and included in the Order Confirmation.
16.2 In the event that one of the clauses in the Terms of Sale is void or ineffective, such nullity or ineffectiveness will not be carried over to further and different contractual clauses, nor will it in any way cause the nullification of the Terms of Sale and/or the related Contract.
16.3 Pursuant to and for the effects of the second paragraph of Art. 1341 c.c., it is stated that clauses 11 (Warranty), 12 (Liability), 15 (Applicable Law and competent court) have been examined, and expressly approved.
